Physiomesh Lawsuit Set for Trial in 2018

A lawsuit involving a man who was seriously injured by Physiomesh has been set for trial on January 22, 2018. The plaintiff developed an infection in and around the mesh, resulting in two abscesses and an intestinal fistula. He required surgery and continues to suffer health problems. The lawsuit (PDF) was filed on April 1, 2016 in the U.S. District Court for the Southern District of Illinois — In Re: Matthew Huff v. Ethicon, Inc.Case No. 3:16-cv-00368.

Ventral Hernia Repair

Physiomesh Flexible Composite Mesh is a patch for ventral hernias, which occur when internal organs bulge out through a weak spot in the abdomen. Hernias develop after 10% of abdominal surgeries, almost always at the site of the surgical incision. Treatment involves pushing organs into the abdomen and stitching in a patch to hold everything in place.

Physiomesh Withdrawn from the Market

May 2016 — Johnson & Johnson’s Ethicon unit has issued a market withdrawal for Physiomesh after two large studies in Germany and Denmark found a higher rate of hernia recurrence and re-operation compared to similar types of hernia mesh.

Hernia Recurrence and Re-Operation

Hernia recurrence is a complication that occurs when a hernia re-opens after it is patched. The only treatment is another operation, but the chances of success diminish with each attempt. Patients are also exposed to a greater risk of surgical complications in general.

Physiomesh Side Effects

  • Chronic pain
  • Infection
  • Hernia recurrence
  • Adhesions (organs sticking together with scar tissue)
  • Intestinal blockage
  • Mesh migration
  • Contraction of the mesh
  • Need for additional surgery

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our lawyers are not filing a Physiomesh class action against Ethicon. Instead, we are filing individual lawsuits for people who had a recurrent hernia or needed surgery.

About Class Actions

Most class actions are filed by a “class representative” on behalf of everyone who was injured. If compensation is awarded to that person by a jury or settlement, everyone with the same injury who joins the class action shares the payout.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Class actions are a great way to get refunds, but they have disadvantages for individuals with severe injuries from defective medical devices. Because these injuries vary widely, each lawsuit needs to be handled individually.

Our lawyers are filing individual lawsuits against Ethicon on behalf of people who had a hernia recurrence or additional surgery after Physiomesh failed prematurely. We specialize in helping our clients seek compensation for their pain and suffering, medical expenses, lost income, permanent injuries, and more.
