July 24, 2024 — A lawsuit has been filed by a man who was paralyzed when his recalled Polaris Ranger 1000 off-road vehicle crashed into a tree.
The lawsuit was filed by Dana H., a man from Washington who was driving a 2021 Polaris Ranger 1000 Premium when he crashed into a tree in July 2022, paralyzing his lower body.
He was unaware that the off-road vehicle had been recalled in December 2021 for a throttle defect that could cause it to fail to slow down even when a driver released the throttle pedal.
He purchased the vehicle from an authorized dealer in September 2021, two months before Polaris issued an expanded recall for Ranger 1000s due to the throttle defect.
In the recall, Polaris warned that the Ranger throttle pedal “can return to the idle position more slowly than anticipated once the pedal is released or stick in the depressed position, posing a crash hazard.”
Polaris has expanded the recall multiple times. There were 279 reports of throttle pedals returning to idle too slowly or sticking, 19 reports of crashes, and multiple injuries, including a leg injury that required surgery.
The lawsuit was filed on July 12, 2024 in the U.S. District Court for the Eastern District of Washington — Case 4:24-cv-05084.
