UPDATE: Rock ‘n Play Linked to 100 Baby Deaths Since 2009

In January 2023, Fisher-Price re-announced a recall for 4.7 million Rock ‘n Play Sleepers and reported that approximately 100 babies had suffocated to death in the product, including 8 babies who died after the Rock ‘n Play was recalled in April 2019. In a statement from CPSC Chairman Alexander Hoehn-Saric:

“We are issuing  this announcement because, despite their removal from the marketplace and a prohibition on their sale, babies continue to die in these products. … Unfortunately, today’s announcement highlights the fact that these products are still in too many homes, and babies continue to be put at risk.”

The danger of the Rock ‘n Play is that babies can suffocate when their face gets trapped against the fabric sides. This can occur when a baby rolls over from their back to their stomach, or twists onto their sides, or under “other circumstances” according to the recall. The incline poses a risk of positional airway obstruction, which occurs in very young babies who are unable to hold their own head up, because the incline forces their chin down into their chest.

Inclined Sleepers Pose Deadly Suffocation Hazard for Babies

More than 100 infant deaths are now linked to inclined sleepers and more than 6 million of these products have been recalled nationwide.

Furthermore, over 1,100 incidents (including serious injuries as well as close calls) were reported by the U.S. Consumer Product Safety Commission (CPSC) between January 2005 and June 2019.

Rock ‘n Play Class Action Lawsuits

At least 3 class action lawsuits are seeking to force Fisher-Price and Mattel to provide refunds or other compensation to everyone who bought a Rock ‘n Play Sleeper without knowing about the deadly suffocation risks. However, these class action lawsuits are NOT seeking compensation for injuries or deaths.

Fisher-Price Hit With Rock ‘n Play Class Actions in New York

On April 18, 2019, a Rock ‘n Play Class Action (PDF) was filed in New York by two parents who say the recall came too late to save their 3-month-old daughter, who suffocated “just a few minutes” after being put in a Rock ‘n Play — Case No. 1:19-cv-00512.

On April 19, 2019, another Rock ‘n Play Class Action (PDF) was filed in New York by Cassandra M., a woman who received a Rock ‘n Play Sleeper as a gift in July 2016 — Case No. 1:19-cv-00518.

The lawsuits state that the Rock ‘n Play is defective and dangerous for infant sleep:

“By positioning the infant at at 30-degree incline, the Rock ‘n Play Sleeper significantly increases the risk that the infant’s head will slip into a dangerous position, tilt to constrict the windpipe and/or cause the infant’s face to become pressed against the padded fabric in the sleeper and block airflow, which the infant may be unable to correct. This increases the risk of death by asphyxiation.”

What is the problem?
