Zimmer Biomet Recalls Shoulder Replacements

Zimmer Biomet issued a Class I recall for 3,662 Comprehensive Reverse Shoulder Implants in February 2017 due to an increased risk of fracture and additional surgery.

The recall only includes shoulder implants manufactured before September 2011. The recalled shoulder replacements were sold from October 2008 until September 2015. The recall notice warns:

“Fractures may result in revision surgeries which could cause serious adverse health consequences such as permanent loss of shoulder function, infection, or rarely, death.”

Biomet issued two previous recalls for the Comprehensive Reverse Shoulder — one in April 2011 and another in September 2010 — due to issues with fractures between the baseplate and trunnion and assembly errors.

$350,000 Payout in Shoulder Replacement Lawsuit

Biomet paid $350,000 to settle a lawsuit over the Comprehensive Reverse Shoulder in February 2016. The plaintiff received implants in both shoulders in 2009 and 2010. Both implants were recalled in 2010 and eventually fractured — Case No. 14-02667.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm. However, our lawyers are not currently filing a class action for people who were injured by shoulder replacements. Instead, we are filing individual shoulder injury lawsuits against manufacturers.

Complications of Reverse Shoulder Replacements

  • Shoulder fracture
  • Loosening
  • Instability
  • Infection
  • Nerve damage
  • Blood or fluid in the joint
  • Loss of shoulder function
  • Surgery
  • Shorter arm after surgery
  • Permanent disability
  • “Frozen Shoulder”
  • Death

About Class Actions

Class actions are useful when a lot of people are seeking reimbursement for bank overcharges or refunds, for example, but they have major disadvantages for people with severe injuries. The problem with class actions is that everyone must share the payout.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Class actions are efficient, but they are not designed to maximize compensation for individuals who suffered the worst injuries. This is why it is unlikely that a shoulder replacement class action will be filed.

Our lawyers specialize in filing lawsuits against manufacturers of defective medical devices. If you were injured by a recalled shoulder implant, you could be eligible to seek compensation for your pain and suffering, medical bills, permanent disability, lost income, and more.
