Valsartan Recall Lawsuits Centralized in Federal Court

In February 2019, federal judges decided to centralize all Valsartan recall lawsuits nationwide into one court — the U.S. District Court for New Jersey under Judge Robert B. Kugler. The litigation includes at least 17 personal injury lawsuits from people who developed cancer.

Valsartan Lawsuits

All of the personal injury lawsuits were filed by people who used generic blood-pressure drugs containing Valsartan. The medications were contaminated with cancer-causing impurities called NDMA or NDEA.

Toxic Impurities in Blood Pressure Medications

N-nitrosodimethylamine (NDMA) or NDEA are toxic impurities are known to cause cancer and liver damage. Lawyers claim that drug-makers such as Zhejiang Huahai Pharmaceutical Company of China knew about the impurities in 2012.

Valsartan Contaminated with Cancer-Causing Impurity

Diovan® (valsartan) is a blood-pressure medication that was first approved in 1996. It is now widely used as generic valsartan. In mid-2018, investigators discovered that certain generic valsartan medications were contaminated with a cancer-causing impurity known as N-nitrosodimethylamine (NDMA). Some generic valsartan products were contaminated since 2012.

Recalled Valsartan Had Dangerous Levels of NDMA

The first valsartan recalls were announced in Europe in July 2018. Days later, the FDA issued a similar valsartan recall, warning that NDMA was likely left over from the manufacturing process. FDA investigators said the valsartan was contaminated with levels of NDMA that far exceeded the level that is safe for human consumption.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not currently filing a Valsartan class action. Instead, we are filing individual lawsuits for people who took a recalled Valsartan medication before developing cancers, such as:

  • Stomach cancer
  • Small intestine cancer
  • Colorectal cancer
  • Esophageal cancer
  • Prostate cancer (only under 65 year olds)
  • Liver cancer
  • Blood cancer
  • Leukemia
  • Bladder cancer
  • Pancreatic cancer
  • Multiple Myeloma
  • Non-Hodgkins Lymphoma

About Class Actions

Class actions are useful when a lot of people have a similar legal claim. The lawsuit is typically filed by one person on behalf of a much larger group of people. Lawyers negotiate compensation for the group. Everyone who joins the class action shares the payout.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Class actions can have major disadvantages for individuals with serious injuries from dangerous medications, especially if their injuries are much worse than the average person who took the medication.

Our law firm specializes in helping people who were injured by defective drugs. If you were injured by Valsartan, we may be able to help you file a lawsuit and seek compensation for your injury, medical expenses, and more.
