Zimmer Durom Cup Lawsuit Settlements

Federal judges centralized over 300 Zimmer Durom Cup lawsuits in the U.S. District Court for the District of New Jersey. These cases are not part of a class action lawsuit — they are individual lawsuits filed by people who hired an attorney.

At least 100 cases have already been resolved, and new cases continue to be filed. Zimmer has set aside $400 million to resolve the litigation, and they may pay $200 million in additional lawsuits.

Zimmer is accused of marketing the Durom Cup as safe and effective, despite evidence linking it to serious complications. Plaintiffs who file a lawsuit could potentially join the federal litigation:

Zimmer Durom Cup Recall

Zimmer Holdings Inc. and the U.S. Food and Drug Administration (FDA) agreed to issue a recall of the Zimmer Durom Acetabular Cup in 2008. Between 2006 and 2008, more than 12,000 people were implanted with the Durom Cup., and many of them reported problems like loosening and revision surgery.

Zimmer sent a Surgeon Letter outlining steps to minimize the risk of complications. On July 22, 2008, they initiated a voluntary recall, warning that instructions about surgical techniques were inadequate.

What’s the problem?

Zimmer stopped selling the Durom Cup after its was associated with a 20-30% rate of problems. In addition, studies linked the Durom Cup to a 5.7% failure-rate. Many people who experienced problems or failure have filed Zimmer hip replacement lawsuits.
