July 30, 2024 — A jury awarded $495 million to a baby who developed Necrotizing Enterocolitis (NEC) after being fed Similac Special Care 24 Infant Formula in the hospital.
The jury in Missouri ordered Abbott Laboratories to pay $95 million in compensatory damages and $400 million in punitive damages to the family of Robynn Davis, a baby who developed NEC within 72 hours after being fed the cow’s milk-based formula in October 2021.
Robynn was born premature at 26 weeks gestation and was given Similac Special Care 24 in the Neonatal Intensive Care Unit (NICU).
After developing NEC, she had to have 75% of her intestine removed, must use a wheelchair, suffered brain damage, and will need around-the-clock care for the rest of her life.
Lawyers argued that Abbott knew the formula could increase the risk of NEC, but failed to adequately warn patients and doctors while aggressively marketing Similac Special Care for use in hospitals.
Abbott and Mead Johnson are facing thousands of lawsuits involving other premature babies who were diagnosed with NEC after being fed cow’s milk-based formula in the hospital.
Earlier this year, a jury in Illinois awarded $60 million in a similar case against Mead Johnson on behalf of a premature baby who developed NEC after being fed Enfamil infant formula.
The lawsuit was filed in the 22nd Judicial Circuit of Missouri — In RE: Gill v. Abbott — Case Number 2322-CC01251.
