Wrongful Death Settlement
One of the first settlements was reached in December 2024, on behalf of Gunter Morgenstein, an 88-year-old man who bought Boar’s Head liverwurst at a local grocery store in Virginia on June 30.
He developed symptoms of a Listeria infection and was hospitalized on July 8, where he was diagnosed with sepsis and listeriosis. Tragically, he passed away on July 18, 2025.
The terms of the settlement were not disclosed, but his wife said he “did not die in vain.” As a result of this tragedy, she said: “Boar’s Head has committed itself to making their food processes safer for everyone.”
Class Action Settlement
Boar’s Head has also agreed to class action lawsuit settlements, for consumers who accuse the company of false advertising.
What Did The Lawsuit Claim?
The class action lawsuit claimed that Boar’s Head misled consumers by failing to warn people about the risk of Listeria contamination in deli meat. The class action was filed by plaintiffs who claimed that they never would have bought Boar’s Head deli meat (or they would have paid significantly less) had they been warned about the risk of contamination with Listeria.
