Boston Scientific did not break down how the settlement would be dispersed, but it works out to an average of $75,000 per plaintiff. The company paid $119 million, or about $40,000 per case, to settle 3,000 lawsuits in April 2015.
The settlements put a sizable dent in a litigation that once involved 30,000 claims in state and federal court. Earlier this month, federal judges reported at 18,000 cases against Boston Scientific were pending in West Virginia. Another 50,000 cases are pending in that same court against other manufacturers.
Boston Scientific has been hit with several eye-popping jury verdicts. In May, a woman who was injured by the company’s Pinnacle and Advantage Fit implants was awarded $100 million, including $75 million in punitive damages. However, a judge slashed the award to $10 million after finding it “grossly disproportionate to the injuries suffered.”
Last year, a jury in Texas ordered Boston Scientific to pay $73 million to Martha Salazar, a woman who was injured by the Obtryx bladder sling implant. According to Law360, the award was reduced by the court and Boston Scientific has agreed to pay $34.5 million.
