August 10, 2022 — Britax Child Safety Inc. will pay a $2.6 million class action lawsuit settlement for consumers in California who bought certain booster seats that could allegedly fail to protect a child in a crash.
Around 57,000 people could join the class action if they bought a new Frontier ClickTight Harness-2-Booster Seat or a Pioneer Harness-2-Booster Seat between August 14, 2016 and August 14, 2020.
The lead plaintiff, Margaret S., is a woman from California who saw a Consumer Reports article in which the booster seats failed crash tests. She claims that she never would have bought a Britax Harness-2-Booster seat for $272 plus tax if she knew about the tests.
In March 2019, Consumer Reports published an article warning parents after 5 car seats failed testing:
- Britax Frontier ClickTight Harness-2-Booster Seat
- Britax Pioneer Harness-2-Booster Seat
- Cosco Finale Booster Seat
- Graco Atlas 65
- Harmony Defender 360
Consumer Reports warned that the structural damage was so severe on one test with the Britax Frontier ClickTight that the harness completely “pulled through” the seat, allowing the harness to loosen.
“These structural failures would increase the risk that a child’s head could come into contact with some part of the vehicle’s interior, or that the child might even be ejected from the car seat.”
Britax asked a judge to dismiss the lawsuit in February 2021, arguing that the seats were not defective and Consumer Reports did not use tests that were approved by federal regulators.
The lawsuit was filed in the U.S. District Court for the Central District of California — Case Number 2:20-cv-07373.
