$7.5 Million Settlement in Las Vegas Benzene Lawsuit

The family of a Las Vegas truck driver who died of leukemia from breathing benzene in gasoline was awarded $7.5 million by a jury in Clark County District Court in October 2011.

The lawsuit was filed by Rick Lewis, a man who was exposed to benzene while working as a tanker-truck driver from 2002 to 2008, when he was diagnosed with Myelodysplastic Syndrome (MDS).

Mr. Lewis was responsible for filling his tanker-truck with gasoline and unloading it at other locations. Every day, he breathed benzene fumes from gasoline that contained 3% benzene. He died of MDS in 2009.

The jury in Las Vegas awarded him compensation after determining that his employer, Kinder Morgan Energy Partners L.P., did not warn employees about the risk of cancer from benzene in gasoline fumes, or provide adequate protective equipment.

Benzene Exposure on the Job

Benzene is a highly-flammable, sweet-smelling chemical that is found in gasoline, paint, solvents, degreasers, glue, engine exhaust, cigarette smoke, and many other products. Millions of workers — especially mechanics and railroad workers — breathe benzene fumes every day or absorb it through the skin by touching benzene products.

Benzene and Cancer

Benzene is a carcinogen (cancer-causing) chemical that is not safe at any level. Over time, benzene accumulates in the bones and increases the risk of developing leukemia and lymphoma. These cancers occur when the bone marrow produces abnormal blood cells.
