June 27, 2023 — A wrongful death lawsuit has been filed by a Texas-based law firm after a deadly outbreak of food poisoning was linked to Dave’s Sushi in Bozeman, Montana.
The wrongful death lawsuit was filed on behalf of William Lewis, a man who ate a “Special Roll” with morel mushrooms at Dave’s Sushi on April 17.
He took himself to the hospital on April 18 with symptoms consistent with food poisoning, but tragically died despite receiving treatment.
Another wrongful death lawsuit was filed on behalf of Donna Ventura, who also ate the “Special Roll” with morel mushrooms on April 17. She fell ill and died on April 29 after suffering from cardiac arrest and organ failure.
As of May 15, 2023, health officials have confirmed that at least 50 people got food poisoning after eating at Dave’s Sushi between March 28 and April 17, including 44 people who reported eating morel mushrooms. Three people were hospitalized, and two deaths are associated with the outbreak.
