Lawsuit Claims Woman Gave Birth to Wrong Children After IVF Mix-Up

In 2019, a lawsuit was filed by a woman from New York who gave birth to other people’s children after her fertility clinic implanted the wrong embryos. The woman was ultimately forced to give her twin boys up to their biological parents. Furthermore, she accuses the fertility clinic of trying to cover up the mistake.

Why Freeze Eggs and Embryos?

Fertility centers freeze eggs and embryos so they may be fertilized and implanted at a later time. Eggs and embryos are preserved through a rapid freezing process, and they remain frozen indefinitely — or until the woman decides to fertilize them. One cycle of freezing and retrieval costs upwards of $8,000, with annual fees of at least $600.

San Francisco Fertility Clinic Lawsuit

In March 2018, a $5 million class action lawsuit was filed against Pacific Fertility Center after thousands of frozen embryos and eggs were destroyed by a malfunctioning cryogenic tank.

Pacific Fertility Center said a piece of equipment in its cyro-storage laboratory “lost liquid nitrogen for a brief period of time” on March 4. Liquid nitrogen in cryogenic tanks continuously evaporates at a slow rate, so it must be replenished on a daily basis. If it is not replenished, the eggs and embryos that are inside the tank will not stay frozen.

Pacific Fertility Class Action Lawsuit

A class action lawsuit (PDF) was filed on behalf of more than 100 people who lost thousands of eggs and embryos, seeking compensation for breach of contract, negligence, and financial and emotional damages.

The fertility clinic is accused of failing to adequately monitor the tanks, permitting a leakage to occur from one of the tanks, and failing to safeguard the eggs and embryos that were entrusted to their care.

Ohio Fertility Center Class Action Lawsuit

The first class action was filed against University Hospitals Fertility Center in March 2018, just days after 700 patients were told that a freezer malfunction damaged about 2,000 frozen eggs and embryos.

The lawsuit was filed on behalf of a couple who had 2 embryos stored in the fertility clinic’s freezer. After the couple were told on March 10 that their embryos are no longer viable, they said: “It’s heartbreaking. Just heartbreaking. The medical community calls it tissue, I like to think of it as my children. My frozen children.”
