June 18, 2021 — A jury has awarded $15 million to five victims whose frozen embryos were destroyed by Pacific Fertility Center in San Francisco, California.
Back in March 2018, five women who were clients of the fertility clinic got an email describing an “unfortunate incident” in which a liquid-nitrogen storage tank malfunctioned.
The accident destroyed about 3,500 frozen eggs, embryos, and other genetic material.
This week, in a historic verdict, a jury awarded them $15 million for their lost eggs and embryos. It is the first-ever jury award in a case of this kind.
Three women were awarded between $2 and $3 million each, while another couple was awarded $7.2 million.
The jury determined that the fertility clinic was only 10% responsible for the destroyed eggs and embryos.
The tank manufacturer, Chart, was found 90% responsible. The jury determined that Chart knew the tank was defective, but failed to issue a recall or warn the fertility clinic of the problem.
