Lawsuit Filed Against CHA Fertility Center in Los Angeles

In 2019, a lawsuit was filed against CHA Fertility Center in Los Angeles by a woman from New York who gave birth to twins that were not genetically related to her, the father, or each other.

The lawsuit claims CHA Fertility Center implanted the wrong embryos, from 2 different couples, after she had paid more than $100,000 for IVF treatments. She was forced to give the babies up to their biological parents.

Class Action Lawsuit Accuses Ohio Hospital of Destroying Eggs & Embryos

In March 2018, University Hospitals in Ohio announced that about 4,000 eggs and embryos for nearly 1,000 couples may have been damaged or destroyed when the temperature rose in a storage tank.

The eggs and embryos were stored in a large liquid nitrogen freezer at the Ahuja Medical Center that malfunctioned.

Couples who entrusted their eggs and embryos to the fertility clinic say they are devastated because they may not be able to have their own children. Some had been trying for years to get pregnant.

Pacific Fertility Class Action Lawsuit

In March 2018, Class action lawsuits (PDF) have been filed against Pacific Fertility Center in San Francisco, California. One of the first class actions was filed by a woman whose frozen eggs were destroyed.

The lawsuit was filed by a woman identified as “S.M.,” whose frozen eggs were destroyed when storage tank No. 4 lost liquid nitrogen. Lawyers estimate that about 400 couples were affected by the loss.

The victims paid thousands of dollars to store their eggs and embryos at Pacific Fertility. One cycle of egg freezing at Pacific Fertility, which includes storage for a year, costs $8,345, with annual storage fees of $600, plus fees for consultations, lab work and medications.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a class action lawsuit against fertility clinics. Instead, we are filing individual lawsuits for people who have legal claims, such as:

  • You received the wrong egg, or the sperm came from the wrong donor (many people discover this through DNA tests)
  • Frozen eggs or embryos were lost, damaged, or destroyed by a fertility clinic.

About Class Actions

Class actions are useful when a lot of people have similar legal claims, especially when they are seeking refunds or reimbursements. However, when an individual has far more serious claims than the average plaintiff, class actions can have disadvantages.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Members of a class action lawsuit may have to accept a “low-ball” settlement or higher attorney fees. They will also have to share the payout with everyone in the class action.

Our lawyers hold companies responsible for failing to do what they promised to do. If your future family was harmed by the negligence of a fertility clinic, we may be able to help you get financial compensation.
