What is the Problem?

Ford has been hit with more than 162 lawsuits involving rollover accidents in which the roof crushed. These lawsuits involve Ford Super Duty pickup trucks that were built from 1999 through 2016, before federal auto-safety regulators ordered manufacturers to strengthen the roofs on vehicles weighing more than 6,000 pounds.

Before 2017, Ford built millions of trucks with roofs that met this standard, even though the trucks weighed more than 6,000 pounds.

Ford has known about this “weak roof” problem for decades, but has never warned owners, issued any recalls, or offered to fix the problem. Instead, Ford has quietly paid out confidential settlements and avoided negative publicity. That all changed in August 2022, when a jury in Georgia slammed Ford with a $1.7 billion verdict for a couple who were crushed when the roof collapsed in a rollover.

Ford Roof Class Action Lawsuit Filed in Michigan

In September 2022, a driver in California filed a class action lawsuit against Ford for knowingly selling 5.2 million trucks with dangerously weak roofs that can crush and kill people in rollover accidents.

Who Filed The Lawsuit?

The class action was filed by Steven B., a man who owns a 2013 Ford F-350 Super Duty pickup truck. He claims that Ford Super Duty trucks that were built between 1999 and 2016 have a dangerously weak roof structure.

What is the Problem?

In the lawsuit, he said “he no longer feels safe in it for fear of what could happen if the vehicle were to be involved in a rollover accident.”

He said he bought the F-350 Super Duty truck to use on his vineyard in Paso Robles, California, and he picked that truck because Ford advertised its safety and reliability. He accuses Ford of “reckless disregard” for the well-being of himself and the other class members.

“This catastrophic injury and death risk is the direct result of a design defect that was known to Ford and is still un-remedied by Ford,” he said. He also accuses Ford of downgrading roof strength to cut costs.

“Ford not only knew that the SuperDuty trucks had unsafe and inadequate roof strength, but since there was no applicable standard regulating roof strength, Ford purposefully downgraded roof strength in order to save manufacturing costs and thereby enhance its profits.”

The plaintiff is seeking to represent a nationwide class of Ford owners and lessees of model-year 1999-2016 Ford Super Duty pickup trucks, including the F-250, F-350, F-450, and F-550.

The class action lawsuit was filed against Ford Motor Company on September 9, 2022 in the U.S. District Court for the Eastern District of Michigan — Case Number 2:22-cv-12079.
