October 23, 2023 — A jury has awarded $745 million to the family of a 25-year-old woman who was killed in a car accident that was caused by a driver who abused Whip-It! nitrous oxide inhalants.
After a two-week trial, the jury in St. Louis, Missouri, found that the company that manufactures Whip-It! nitrous oxide and the store that sold it were both liable for the car accident.
The lawsuit was filed against Coughing Cardinal LLC, a smoke shop company that sells Whip-It! nitrous oxide, and the manufacturer of the product, United Brands Corporation.
The jury found that the young man who caused the accident was 10% responsible for the crash. Coughing Cardinal was found 20% responsible and United Brands Corporation was slammed with 70% of the verdict.
The car accident was caused by Trenton Geiger, a 22-year-old man who admitted to “huffing” fumes from a Whip-It! before he passed out and crashed his SUV into a building.
His vehicle pinned 25-year-old Marissa Politte to the building as she was leaving her job as a radiology tech, according to court documents. She was rushed to a nearby hospital, but died of her injuries.
Whip-It! (also known as a “whippet” or laughing gas) is a popular brand of nitrous oxide. It is sold in small canisters as a recreational drug, and people who breathe it quickly experience a euphoric high.
The effects of the high are short-lived, typically lasting only a few minutes, but it can lead to dangerous side effects.
