Some flooring products sold by Lowe’s contain up to 10X the acceptable levels of formaldehyde, a toxic carcinogenic (cancer-causing) chemical, according to a new report.
Too Much Formaldehyde in Lowe’s Flooring?
In May 2015, Seeking Alpha published an analysis suggesting that some Chinese-made laminate flooring products sold by Lowe’s contain too much formaldehyde.
Similar accusations were raised against Lumber Liquidators back in 2013, but were largely ignored until 60 Minutes picked up the story in March 2015.
Undercover investigators with 60 Minutes recorded employees at Chinese mills who openly admitted that their products were not compliant with limits set by the California Air Resources Board (CARB).
Lowe’s was accused of selling toxic flooring that were mislabeled as CARB-compliant:
“Independent tests show that one of Lowe’s floors scores 10x the allowed formaldehyde threshold. To put that in context, 60 Minutes tested 31 samples from Lumber Liquidators; Lowe’s Chocolate Cherry Hickory would have been the third worst of all 31 samples.”
Like the 60 Minutes investigation, Lowe’s is accused of selling dangerous products that were mislabeled as CARB-compliant. Soon after the report was published, Lowe’s responded by pulling all Tecsun products off the market, according to Bloomberg.
Lowe’s Class Action Lawsuit
The Schmidt Firm, PLLC is nationally recognized as a class action law firm. However, our attorneys are not filing a class action lawsuit against Lowe’s. Instead, we are investigating injury lawsuits involving people who had health problems from formaldehyde in flooring.
About Class Actions
Class actions have already been filed against Lumber Liquidators by people who are seeking reimbursement for flooring that contains too much formaldehyde. This type of lawsuit is ideal when a large number of people have a similar legal claim, but it would be impractical for everyone to file a lawsuit alone.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
Class actions can have major disadvantages for people with very serious injuries. They may have to accept a “low-ball” settlement with high attorneys’ fees, even if their lawsuit is never taken to trial.
Our attorneys file individual lawsuits because we believe people who were injured by defective, dangerous products deserve a personal legal representative. We are committed to seeking justice and maximizing compensation for each of our clients.
