RECALL: 6,800 Luyuan ATVs for Kids Recalled for Crash Hazard
In September 2021, Luyuan recalled about 6,800 Youth All-Terrain Vehicles (ATVs) due to a serious crash hazard, according to the warning:
“The youth ATVs fail to comply with the requirements of the federal mandatory ATV safety standard, including maximum speed limitations and other mandatory safety requirements for vehicles intended for children under 10 years of age. ATVs that fail to meet the mandatory safety requirements pose a risk of serious injury or death to children.”
The recalled ATVs were sold from August 2018 through August 2020 and intended for use by children ages 6 years and older, as demonstrated by the product dimensions and advertising. The ATVs were also marketed on Amazon.com to children as young as 12 months of age and on Walmart.com to children age 5 years.
Luyuan ATVs Pose Deadly Risks to Kids, CPSC Warns
In January 2021, Luyuan Inc. and the U.S. Consumer Product Safety Commission (CPSC) warned parents not to let children ride any model of Luyuan youth ATVs due to a crash hazard, and a risk of serious injuries or death.
What is the Problem?
Luyuan youth ATVs do not have a mandatory limit on the maximum speed, or other mandatory safety features for children under 10 years old. Furthermore, while Luyuan ATVs are intended for children over the age of 6, they were advertised to children as young as 12 months old on Amazon.com, and for 5 year-old children on walmart.com.
What is the Risk?
The CPSC warned that Luyuan ATVs pose “a risk of a high-speed crash that may result in serious injury or death to young children.” ATV crashes kill more children than bicycles, according to the American Academy of Pediatrics (AAP). In 2015, at least 73 children under 16 years old died, and 26,700 were seriously injured by ATVs, according to the AAP.
How to Identify a Luyuan ATV
Luyuan ATVs were made in China and distributed in the U.S. from August 2018 through August 2020. The model numbers are LY-ATV-40A, LY-ATV-40D, LY-ATV-40E and LY-ATV-40I. Some of the ATVs were sold under the brand-names GBMOTO® or GoBowen®.
What Stores Sold the ATVs?
The ATVs were sold online at www.amazon.com, www.walmart.com, www.familygokarts.com, www.Bigtoysgreencountry.com, www.Bigtoysusa.com and www.Saferwholesale.com.
Stores that sold Luyuan ATVs include Tool Store Go-Kart Shop, ATV Distributors, Four Seasons Power Sports, Mefast Wholesale, Toomey Tools, Steward Auto, A&S Auto, and Bounce it Off Motorsports.
Did Luyuan Issue a Recall?
As of January 27, 2021, Luyuan has NOT recalled the ATVs, despite being pressured to do so by the CPSC. Instead, Luyuan said it is developing a remedy to fix the safety violations. It is possible that a recall will be announced in the future.
