UPDATE: MamaRoo Class Action Lawsuit Filed After Baby Strangles to Death

In August 2022, a class action lawsuit was filed against 4moms after a baby tragically strangled to death on a now-recalled MamaRoo Baby Swing.

The lawsuit accuses 4moms of putting profits over child safety by continuing to sell the MamaRoo and RockaRoo for 3 years after a report of a baby strangling in August 2018.

According to the complaint: “4moms was aware of the risk of infant strangulation of the recalled devices in August of 2018, when the first injury of this kind was reported to them. … Yet, defendant continued to manufacture and sell the recalled devices.”

Consumers in the U.S. would be eligible to join the class action if they bought 4moms MamaRoo Baby Swings or RockaRoo Rockers between January 2010 and August 2022.

The MamaRoo Class Action Lawsuit was filed on August 29, 2022 in the U.S. District Court for the Western District of Pennsylvania – Case Number 2:05-mc-02025.

2 Million MamaRoo Baby Swings Recalled After Infant Strangles to Death on Straps

In August 2022, 4moms recalled over 2 million MamaRoo Baby Swings and RockaRoo Baby Rockers because crawling infants can strangle to death on hanging straps.

What is the problem?

The restraint straps can dangle below the seat when it is not being used, which poses a strangulation hazard to crawling infants.

4moms said it received two reports of entanglement incidents involving infants who became caught in the strap under the unoccupied MamaRoo infant swing after they crawled under the seat.

Death of 10-Month Old Baby Linked to MamaRoo

One 10-month-old infant died from asphyxiation (strangling to death after being twisted in the strap), and another 10-month-old infant suffered bruising to his neck before being rescued by a caregiver.

According to the U.S. Consumer Product Safety Commission (CPSC):

“When the swing or rocker is not in use, their restraint straps can dangle below the seat and non-occupant crawling infants can become entangled in the straps, posing a strangulation hazard.”

Where Were They Sold?

The recalled baby swings and rockers were sold at BuyBuy Baby and Target stores nationwide and online at 4moms.com and Amazon from January 2010 through August 2022 for between $160 and $250.

Was My Baby Swing Recalled?

The recall involves about 2 million MamaRoo Baby Swings (versions 1.0 through 4.0) plus another 220,000 RockaRoo Baby Rockers (Model 4M-012). Another 70,000 products were sold in Canada.

The recalled MamaRoo Baby Swings use a 3-point harness: versions 1.0 and 2.0 (model number 4M-005), version 3.0 (model number 1026), and version 4.0 (model number 1037). The MamaRoo model that uses a 5-point harness is not included in this recall.

Baby Swings Recalled After Deaths Reported

MamaRoo and RockaRoo Swings and Rockers have an inclined surface that poses a suffocation hazard for babies who flip over from their back onto their stomach.

In recent years, recalls have been issued for millions of baby products with inclined sleeping surfaces, including baby swings and gliders. Around 100 baby deaths have been reported, and more than 1,100 serious injuries or close calls.
