Energy Drinks and Hepatitis

Monster Energy contains a blend of B-vitamins, such as niacin (Vitamin B3). In high doses, niacin accumulates in the liver and causes inflammation. There are case reports of people who consumed excessive amounts of niacin in energy drinks and developed toxic hepatitis or acute non-viral hepatitis.

Monster Energy Class Action Lawsuits

The first class action lawsuits against Monster Energy were filed in California in 2012. One plaintiff, Alec Fisher, filed a class action accusing Monster of avoiding FDA regulation by marketing energy drinks as “dietary supplements” rather than beverages. In Mach 2013, Monster agreed to re-classify their energy drinks as beverages and add caffeine content to the label. November 2013, Fisher’s class action was dismissed.

Monster Energy EGCG Lawsuit

In November 2012, another class action was filed in California was filed by Jennifer Wooding, a woman who says Monster Rehab Green Tea + Energy contains an ingredient that causes liver damage. According to the lawsuit, it contains “a toxic and potentially lethal ingredient” called “epicallocatechin-3-gallate” or ECGC, which has been associated with “dangerous hepatotoxic effects, including without limitation, death, acute liver failure, hepatitis and other liver injuries.”

Monster Energy Drink Injury Lawsuits

Monster has already agreed to settlements involving several teenagers who were injured or died. In February 2016, a law firm in Orlando filed five personal injury lawsuits against Monster, including one on behalf of a 14 year-old who had a stroke.

Injury Lawsuits Not Part of a Class Action

This is not the first time Monster has been sued by people who were severely injured. However, the lawsuits are not part of a class action. Instead, they are individual lawsuits filed by people with their own lawyers. In the future, judges may decide to centralize this rapidly-growing litigation in a state or federal court.
