Nissin Cup Noodle Lawsuit

Nissin Cup Noodle Lawsuit

Nissin Foods sells Cup Noodles, Top Ramen, and many other popular brands of instant noodle soup. Unfortunately, numerous studies have linked the tall, narrow design of Nissin Cup Noodles to a serious risk of burn injuries — especially for children, who are more likely to suffer severe burns when the hot noodles stick to their skin.

What are Nissin Cup Noodles?

Nissin Foods is the Japanese-based manufacturer of the most popular brands of instant noodle soup in the world. The founder of the company, Momofuku Ando, invented instant noodles in 1958 and cup noodles in 1971.

Cup Noodles is designed with a styrofoam cup filled with dehydrated, flash-fried noodles, dehydrated vegetables, and a seasoning packet. The label instructs customers to heat boiling water in a separate microwaveable container, add the water to Cup Noodles, close the lid, and allow it to cook in the cup.

Nissin noodle soup products include:

  • Nissin Cup Noodles
  • Nissin Ramen Noodle Soup
  • Nissin Big Cup Noodles
  • Nissin Souper Meal
  • And more

What is the problem?

The problem with Cup Noodles and similarly-designed products is that they are more likely to tip over than bowl-shaped designs. Furthermore, sticky noodles cause more severe burns than watery soups because they stay hot longer and stick to a person’s skin.

Researchers have published numerous studies on this defective design since 2006. They recommend simple design changes, like making the base wider and the cup shorter. Manufacturers have not made these changes or added additional warnings.

Children are especially prone to Cup Noodle soup burns because they have thinner skin than adults. The boiling point of water is 212ºF or 100ºC. According to warnings from Shriner’s Hospital Burn Awareness:

“People of all ages can be burned in 30 seconds by a flowing liquid that is 130° F; at 140° F, it takes only 5 seconds; at 160° F, it only takes 1 second. For children under 5, these temperatures can cause a burn in half the time.”

Symptoms of a Cup Noodle Burn Injury

  • 1st-degree burn: Redness, swelling, mild or moderate pain.
  • 2nd-degree burn:: Blisters, bright-red, swelling, severe pain.
  • 3rd-degree burn: No pain (nerves are damaged), skin is waxy, dry, leathery, white.

Cup Noodle Burn Complications in Children

Children under the age of 5 are especially vulnerable to injury from a defective instant noodle cup. According to this study, they are more likely to pull down containers of hot liquid. Even small amounts of liquid can burn a large percentage of a child’s body. One of the most severe complications is growth disturbances due to severe scarring. Many children also suffer from:

  • scarring
  • infection
  • disfigurement
  • skin grafts
  • reconstructive surgery

Treatment for Cup Noodle Soup Burns

1st- and 2nd-Degree Burn Treatment: If the burn is larger than3-inches in diameter, seek emergency medical attention. Remove Cup Noodles from the skin and cool the skin under running water for 10-15 minutes. If running water is not available, apply a cool compress or immerse the skin in cool water. Do not apply ice, butter, or oil. When the burn is dry, cover with a sterile gauze dressing.

3rd-Degree Burn Treatment: Remove Cup Noodles from the skin and call 911 or seek emergency medical attention. The patient may need to be hospitalized to receive intravenous (IV) fluids, nutrition, antibiotics, and painkillers. They may need debridement (surgically scraping off dead skin and tissue) and a skin graft from a healthy part of the body.
