Symptoms of Listeria can take up to 10 weeks to appear, and pregnant women may have no symptoms but lose their unborn baby, according to the CDC. More than 7.2 million pounds of Boar’s Head deli meat products have been recalled nationwide.
What Should I Do?
Do not eat recalled deli meat products. CDC always advises people who are pregnant, aged 65 or older, or have a weakened immune system, to avoid eating deli meats or to heat them before consuming.
Boar’s Head Class Action Lawsuit Filed in New York
In August 2024, a woman from New York filed a proposed class action lawsuit against Boar’s Head after the company recalled 7 million pounds of deli meat that was linked to a deadly outbreak of Listeria food poisoning.
Who Filed The Class Action Lawsuit?
The class action lawsuit was filed by Rita J. T., a resident of Queens County, New York, who purchased Boar’s Head Ham from a local Shop Rite store for about $11.54 during the recall period.
She claims that she never would have purchased the deli meat if she had known that it may be contaminated with Listeria. In her lawsuit, she claims that the deli meat products were actually “worthless because they possibly contained Listeria.”
Boar’s Head is also accused of conducting a recall that will benefit “very few of the customers,” according to the lawsuit, because many customers will throw out the products instead of return them to a store.
The proposed Boar’s Head class action lawsuit was filed on August 1, 2024 in the U.S. District Court for the Eastern District of New York — Case Number 1:24-cv-05405.
