May 25, 2023 — Another wrongful death lawsuit has been filed in Georgia on behalf of a couple who died in a rollover accident when the roof collapsed on their Ford F-250 Super Duty pickup truck.
The lawsuit was filed by the children of Herman and Debra Sue M., a couple who died in August 2022 when their 2015 Ford F-250 veered off the road and crashed into a culvert. The roof crushed down on top of them when the truck rolled over and ended up on its roof.
According to the lawsuit, Debra died at the scene of the accident and Herman was hospitalized for 9 days before dying as a result of his injuries.
The deadly crash occurred just 3 days after a jury in Georgia awarded $1.7 billion to the sons of another couple who died when the roof of their 2002 model-year Ford F-250 Super Duty truck collapsed in a rollover crash in 2014.
The lawsuit alleges that Ford sold over 5.2 million Super Duty trucks with virtually identical roof designs from the 1999 to 2016 model-years. Lawyers claim that Ford has known for over 20 years that the roofs on these trucks are “dangerously weak, defective, and deadly.”
Lawyers estimate that Ford has been sued over 200 times as a result of these roof crush injuries and deaths in Super Duty trucks. Ford has settled all of those lawsuits, except a few that went to trial.
The lawsuit was filed against Ford Motor Company on May 23, 2023 in the U.S. District Court for the Middle District of Georgia (Columbus Division) — Case 4:23-cv-00088-CDL.
