$1 Million Lyft Insurance Policy

Lyft provides a $1 million insurance policy, including uninsured/under-insured motorist coverage, for injuries that occur in car accidents when a Lyft driver is giving a ride or on the way to pick up passengers. In comparison, ordinary motorists may have only $30,000 in coverage.

What Happens After a Lyft Car Accident?

Passengers in a Lyft car who were injured are typically eligible for up to $1 million, regardless of whether the driver was responsible or not. This policy pays compensation for pain and suffering, medical expenses, lost income, permanent disability, and wrongful death.

What About Lyft Drivers Injured in Accidents?

Lyft drivers may or may not be covered. If they are not logged into the app when the accident occurs, the driver’s personal insurance applies. If the driver is in “Driver Mode,” Lyft provides up to $50,000 per injured person, up to $100,000 per accident, and up to $25,000 for damage.

The $1,000,000 policy applies to Lyft drivers who are injured in car accidents between the time they accept a ride until the time the ride ends — but only if the Lyft driver was not responsible for the crash.

Lawsuit Filed After Deadly Lyft Accident

The first wrongful death lawsuit against Lyft was filed after a fatal car accident on Halloween night in 2014, when 24 year-old Shane Holland and his boyfriend took a Lyft home on a rainy night. The driver swerved to avoid a Kia stopped in the middle of Interstate-80 near Sacramento, swerving off the road into two trees.

Lyft Lawsuit Settlement Delayed 18 Months

The car accident that killed Mr. Holland resulted in two lawsuits in July 2015 — one for wrongful death and another for personal injuries. But after an 18-month delayed settlement payout, the victims of this tragic accident accused Lyft of “dragging its heels” on taking responsibility.

Can a Lyft Accident Lawyer Help?

Lawyers can help you seek compensation when Lyft refuses to pay compensation for your car accident. It is important to talk to a lawyer as soon as you think you may have a legal claim against Lyft. There are serious issues that can arise when a Lyft driver is “on the clock” but not carrying a passenger or on the way to pick someone up.

What is the Problem?

Lyft maintains that its drivers are not employees, but independent contractors. This can make it more challenging to hold Lyft responsible when an off-duty driver is involved in a car accident — or when there is disagreement about who is responsible for causing the accident.

Lyft may pay compensation in the following situations:

  • Lyft passengers involved in an accident, regardless of what driver was at fault
  • On-duty Lyft drivers involved in an accident when the other driver was at fault
  • Motorists involved in an accident when an on-duty Lyft driver was at fault

Types of Car Accident Injuries

  • Traumatic brain injuries
  • Spinal cord damage
  • Paralysis
  • Whiplash and neck injuries
  • Amputation or loss of limb
  • Burns
  • Broken bones
  • Death
