Neocate Class Action Lawsuit

Neocate Class Action Lawsuit

Neocate formula does not contain some of the essential nutrients needed for babies to develop strong bones — specifically Phosphates, Potassium, and Sodium. Without these nutrients, babies can suffer severe bone development problems.

The Schmidt Firm, PLLC is currently accepting Neocate induced injury cases in all 50 states. If your baby or somebody you know has been diagnosed with broken bones, fractures, or rickets after being given Neocate baby formula, you should contact our lawyers immediately for a free case consultation. What is Neocate?

Neocate® baby formula is an amino-acid-based baby food, also called an “elemental formula,” that is manufactured by Nutricia. It is designed for babies who are allergic to cow’s milk, soy, and other foods.

Parent Accused of Child Abuse After Unexplained Bone Fractures

There has been at least one parent was accused of child abuse because of unexplained bone fractures. The case was only resolved after the father saw a TV commercial from an attorney who was warning parents about the risk of bone fractures and rickets from Neocate.

Symptoms of Rickets

  • Broken bones
  • Bone pain or tenderness
  • Slow growth
  • Deformities of the bones or teeth
  • Muscle weakness
  • Bowed legs or “knock knees”
  • Thickened wrists or ankles
  • Breastbone protrudes

Neocate Formula Linked to Bone Fractures

Babies who are only fed Neocate are at risk of developing low phosphate levels. When there is not enough phosphate in the body, it significantly increases the risk of bone fractures, rickets, and under-mineralization of the bones.

Study Finds Bone Problems in 94% of Babies on Neocate

In April 2017, a study by Yale researchers published in the Bone Journal found 51 children with low phosphate levels who were fed Neocate. Of those children, 94% also had rickets, bone fractures, or under-mineralization of the bones.

Types of Neocate Baby Formula Injuries

  • Unexplained bone fractures
  • Broken bones
  • Rickets
  • Low phosphate levels
  • Hypophosphatemia
  • Under-mineralization of the bones
  • Bone development problems
  • Permanent disfigurement
  • Misdiagnosis of child abuse

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a Neocate class action lawsuit. Instead, we are filing individual lawsuits for children who were diagnosed with rickets, bone fractures, and other injuries after being given Neocate.

About Class Actions

Class actions are useful when a lot of people with similar legal claims are seeking a relatively minor payout, such as a refund. However, because everyone in the class action shares the payout, class actions can have serious disadvantages for individuals with far more serious injuries than the average person who joins the class action lawsuit.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

There is no excuse for selling a defective product that causes irreparable harm to infants and children. Our law firm is filing individual Neocate lawsuits so we can focus on helping children with the most serious injuries seek compensation for their pain and suffering, medical bills, future treatment, permanent disfigurement and more.
