Lawyers Seeking to Consolidate Ozempic Lawsuits in MDL

In December 2023, a group of plaintiffs filed a motion requesting that judges establish a Multi-District Litigation (MDL) to centralize Ozempic lawsuits into a single federal court, under one judge. The plaintiffs said there are currently 18 cases pending nationwide, but lawyers are investigating more than 10,000 other lawsuits that could be filed soon.

What is an MDL?

The Multi-District Litigation (MDL) process is a common way to coordinate lawsuits involving defective medications and products.

When a lot of people are injured by a medication’s side effects an they all file similar lawsuits, these lawsuits may be centralized into a MDL rather than a class action. The MDL process is similar to a class action, but unlike a class action, each lawsuit remains independent.

Stomach Problems With Ozempic

A growing number of lawsuits have been filed by people who were injured by Ozempic and other medications in a new class of diabetes drugs called glucacon peptide-1 (GLP-1) receptor agonists.

These drugs were originally approved to treat type-2 diabetes, but they are becoming popular weight-loss medications. Unfortunately, patients are developing severe gastrointestinal problems, such as:

  • Stomach paralysis
  • Gastroparesis
  • Ileus (lack of movement of food through the intestines)
  • Intestinal pseudo obstruction

Some people on Ozempic are experiencing stomach paralysis (gastroparesis), which is a side effect that occurs when the movement of food from the stomach into the intestines slows down too much. This can cause severe nausea, vomiting, abdominal pain, malnutrition, bloating, and more.

They claim that Novo Nordisk and other drug-makers knew (or should have known) about the risk of stomach paralysis from Ozempic because it slows gastric emptying, but they failed to adequately warn patients or doctors about the risk.

According to these lawsuits, the label on Ozempic only warns patients about the risk of “delayed gastric emptying,” but does not explain the risk of severe complications like gastric stasis.
