Snuga Swing Class Action Lawsuit Filed Against Fisher-Price
In October 2024, a class action lawsuit was filed by a mother who said she never would have bought a Fisher-Price Snuga Swing for her baby girl if she had known about risk of suffocation and death.
Who Filed The Class Action Lawsuit?
The class action lawsuit was filed by Destini B., a mother who accused Fisher-Price of failing to disclose the risks of the Snuga Swing and inadequately recalling the products after 5 babies died.
What Did The Lawsuit Claim?
In her lawsuit, she claims that Fisher-Price knew (or should have known) that Snuga Swings had deadly safety risks as early as 2014, after another mother reported that her 3-month-old son got trapped and had his breathing restricted. In 2019, another mother told Fisher-Price that her 5-month-old son got his head stuck under the pillow.
The class action also called the $25 refund inadequate. She said Fisher-Price should have offered a full $160 refund and encouraged parents to throw out all Snuga Swings and stop selling them online.
The Snuga Swing Class Action Lawsuit was filed against Fisher-Price and its parent company, Mattel, in the U.S. District Court for the Western District of New York — Case Number 1:24-cv-00992.
What Happened?
Fisher-Price recalled about 2 million Snuga Swings after 5 infants died while using it to sleep. Instead of offering a full refund for the $160 swing, Fisher-Price only offered a $25 credit if parents agreed to take out the pillow and other extra bedding that Fisher-Price included in the recalled swing.
Safety Officials Call Snuga Swing Recall “Not Good Enough”
In an angry statement along with the recall, CPSC Commissioner Richard Trumka called the recall “not good enough to keep babies safe” and warned that multiple babies had died in this product.
He said the recall was “doomed to fail and will keep many babies in harm’s way,” because Fisher-Price encourages “continuing to use the swing” with the excess bedding materials removed. He said:
“My advice: get your $25 refund and then throw this product away; do not keep it in your homes because even after the so-called “repair” this product will still be unsafe for infant sleep.”
Snuga Swing Recall
On October 10, 2024, Fisher-Price recalled over 2.1 million Snuga Swings in the U.S. after reports of 5 babies who tragically suffocated to death.
The recall involves all 21 models of the Fisher-Price Snuga Swing. They were sold from October 2010 through January 2024 at Amazon, Toys R Us, Walmart, Sams Club, Target, and many other stores.
5 Baby Deaths Linked to Fisher-Price Snuga Swings
Between 2012 and 2022, there were reports of 5 babies who suffocated to death when they fell asleep in the Fisher-Price Snuga Swing. The infants who died were between 1 month and 3 months old.
According to the recall warning: “If the product is used for sleep or bedding material is added, the headrest and body support insert on the seat pad can increase the risk of suffocation.”
What Should I Do?
Fisher-Price reminded parents and caregivers to NEVER use the recalled Snuga Swings for infant sleep, and offered a $25 refund with proof of removing the extra bedding material by cutting off the headrest and removign the body support insert from the seat pad.
