February 13, 2024 — A lawsuit has been filed by a man who was infected with Listeria after eating Costco Chicken Wraps.
The plaintiff, Kyle D., is a man from Florida who claims that he bought multiple Southwest Chicken Wraps from a Costco store in Pompano Beach that contained ingredients made by Rizo-Lopez Foods.
In January 2024, he began experiencing body pain, discharge from his belly button, underwent surgery, and was diagnosed with a bacterial infection due to Listeria.
Soon afterward, an outbreak of Listeria was linked to dairy products manufactured by Rizo-Lopez Foods.
On February 7, Fresh Creative Foods recalled cotija cheese that was manufactured by Rizo-Lopez Foods and used in the Southwest Chicken Wraps that were sold at Costco.
Costco also sent a recall notice to customers throughout the U.S., warning them about the recall for Southwest Chicken Wraps that may be contaminated with Listeria monocytogenes.
The lawsuit was filed against Costco on February 9, 2024 in the U.S. District Court for the Southern District of Florida (Miami Division) — Case 0:24-cv-60231.
