Kidde Fire Extinguisher Recall

In November 2017, Kidde recalled 40.5 million fire extinguishers with plastic handles. There were 391 reports of failed or limited activation, nozzle detachment, 16 injuries (smoke inhalation and burns) and 91 cases of property damage because it did not work.

According to the Consumer Product Safety Commission (CPSC):

“The fire extinguishers can become clogged or require excessive force to discharge and can fail to activate during a fire emergency. In addition, the nozzle can detach with enough force to pose an impact hazard.”

The recall was issued 3 years after a person died in a car fire because emergency responders could not get the fire extinguisher to work.

The recall involves 134 models of fire extinguishers that have been sold since January 1973, including Kidde plastic-handled fire extinguishers and also the push-button Pindicator fire extinguishers.

They were sold at Montgomery Ward, Sears, Walmart, Costco, Home Depot, other stores, and online retailers. The fire extinguishers were also sold with some boats, RVs, and commercial trucks.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but our lawyers are not filing a class action lawsuit against Kidde. Instead, we are filing individual lawsuits for the following legal claims:

  • Injury or wrongful death because a Kidde fire extinguisher did not work
  • Impact injury from nozzle detachment
  • Smoke inhalation
  • Burns
  • Property damage claims over $250,000

About Class Actions

Class actions are usually filed by 1 person for everyone else who has the same legal claim. This has several advantages. Each person who joins the class action lawsuit gets to shares the payout collectively.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

There can be disadvantages to class actions for people with far more serious injuries than the average person. People who join a class action might have to accept a “low-ball” settlement or higher fees.

Our lawyers file individual lawsuits so we can focus on maximizing compensation for people who suffered the most severe injuries from defective products. If you were injured by a Kidde fire extinguisher or had property damage claims in excess of $250,000, we may be able to help you get compensation for your medical expenses — and more.
