Lawyers Seeking to Consolidate Mounjaro Lawsuits in MDL
In December 2023, lawyers representing people who were injured by Mounjaro, Ozempic, and other diabetes drugs filed a motion asking judges to centralize lawsuits involving stomach paralysis (Gastroparesis) into a MDL, which is similar to a class action.
What is MDL?
Multi-district Litigation (MDL) is a legal procedure that is designed to streamline complex cases, including pharmaceutical litigation where a large number of people are injured by a side effect of a medication. The MDL is designed to improve efficiency and convenience for all of the parties involved in the litigation. It allows federal civil lawsuits from around the country to be transferred into one federal district court, where they are overseen by one judge. The judge chooses cases to go in front of a jury (called “bellwether trials”) and the outcome of these trials helps lawyers negotiate a settlement or other resolution.
Stomach Problems With Mounjaro
Mounjaro belongs to a new class of diabetes and weight-loss medications known as glucacon peptide-1 (GLP-1) receptor agonists. GLP-1 receptor agonists are known to slow down the digestion of food, which helps people feel full longer and eat less food. Unfortunately, some patients are developing side effects, such as:
- Stomach paralysis
- Gastric stasis
- Ileus (lack of movement of food through the intestines)
- Intestinal pseudo obstruction
Lawsuits Claim Mounjaro Causes Stomach Paralysis
Mounjaro patients are filing lawsuits after experiencing a severe side effect known as stomach paralysis (gastroparesis), which occurs when food does not move quickly enough through the digestive system. The symptoms include severe nausea, vomiting, abdominal pain, malnutrition, bloating, and more.
Can I Join a Class Action Lawsuit?
The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing an Mounjaro class action lawsuit. Instead, we are filing individual lawsuits for people who were injured by Mounjaro side effects, such as stomach paralysis and gastroparesis.
About Class Actions
Lawsuits are currently being filed by people who were injured by Mounjaro, but not into a class action. Instead, people are filing individual Mounjaro lawsuits into U.S. District Courts nationwide.
What Do These Lawsuits Claim?
Mounjaro lawsuits accuse pharmaceutical companies of downplaying the risk of stomach paralysis. These lawsuits claim that drug-makers knew (or should have known) about the risk of stomach paralysis, but failed to adequately warn patients about how severe it can become.
Why Our Law Firm is Filing Individual Mounjaro Lawsuits
